Federalism and Terri Schiavo

I noticed that one of the commenters over at The Wide Awakes stated that Congress’ intervention on Ms. Schiavo’s behalf was an unwarranted intrusion on state’s rights. And of course she accused the conservatives who have championed states rights in the past of hypocrisy.

Ann Althouse, a law professor at the University of Wisconsin has some great perspective in a post that deals with just the points the above referenced commenter made.

It is well worth the read.

  1. You need to go back and reread my comments. I did not use the word hypocrisy and moreover I was making precisely the point Althouse made. I just didn’t spell it out. However, anyone who has read previous comments of mine, there were a flurry of them recently on this subject, could have easily connected the dots.

  2. Let me add though, I think it is an awful mistake of Congress to pass legislation for one person. The legislation they passed does not apply to everyone only Terry Shiavo. So the state’s laws still apply to everyone but her.

  4. John you missed the real story. She is disabled. The feeding tube is a convenience, a tool she needs for her disability. She is alive and disabled that is the story. Disability is not a crime and its not the right of the State or a State to kill people because they are disabled. That is the story.
